Declaration of heir – a professional template in Word format
By a declaration of heir an heir states in the probate proceedings whether he or she accepts the inheritance or renounces it. As a rule the declaration is given orally for the record before a notary public acting as a court commissioner or before the court, but it may also be given in a written document on which the heir’s signature has been publicly certified. This template serves both to prepare the declaration and to draw up such a written, certified declaration.
The declaration of heir is governed by the Inheritance Act (Zakon o nasljeđivanju). The most important provision, and the one people are least aware of, is in Article 130(2) – a renunciation also applies to the descendants of the person renouncing, unless that person expressly declares that he or she renounces in their own name only. That is why the renunciation form contains two clearly separated options, one of which you must choose.

Legal framework
Inheritance Act (Zakon o nasljeđivanju) – the declaration is given orally for the record or in a written document with a publicly certified signature (Article 220), and a renunciation also applies to the descendants of the person renouncing unless he or she has renounced expressly in their own name only (Article 130(2)).
LEGAL NOTES*
A declaration renouncing an inheritance is irrevocable – once given it cannot be withdrawn or amended. Before giving the declaration, check the composition of the estate, that is both the assets and the debts of the deceased.
A renunciation also applies to the descendants of the person renouncing, unless that person expressly declares that he or she renounces in their own name only. In the renunciation form you must choose one of the two options offered, because it determines whether your children will inherit in your place.
Renouncing “in favour of” a particular person is not legally a renunciation but an acceptance of the inheritance with an assignment of your share to that co-heir, so also check the tax treatment of the assignment. For minors and persons under guardianship the declaration is given by the legal representative, as a rule with the approval of the competent authority.
