Last will and testament – a professional template in Word format
A will is a declaration by which a person disposes of their property in the event of death – deciding who inherits the real estate, the money in the bank account and the movable property. This template contains the two forms recognised by law which a person can draw up on their own: a holograph will and a written will before two witnesses. You choose one form, delete the other and fill in the details.
A will is a strictly formal document – it is governed by the Inheritance Act (Zakon o nasljeđivanju), and a will that does not meet the prescribed form is not valid. A holograph will (Article 30 of the Inheritance Act) must be written entirely in the testator’s own hand and signed by their own hand, while a written will before witnesses (Article 31) may be typed but requires two witnesses present at the same time. The template gives an express warning about those conditions in both places.

Legal framework
Inheritance Act (Zakon o nasljeđivanju) – Article 30 (holograph will), Article 31 (will before witnesses), Articles 35 and 36 (witnesses and dispositions that are null and void), Articles 69 and 70 (forced share). A holograph will must be written and signed entirely in the testator’s own hand.

With a will before witnesses, a witness may not be the testator’s descendant, adopted child and their descendant, ancestor or adoptive parent, a relative in the collateral line up to and including the fourth degree, the spouse of any of those persons, or the testator’s spouse (Article 35 of the Inheritance Act). In addition, provisions leaving anything to the person who drew up the will, to the witnesses or to their close relatives are null and void (Article 36), so choose witnesses from outside the circle of heirs.
Descendants and the spouse, and under the statutory conditions also the parents, are entitled to a forced share (nužni dio) regardless of the content of the will. Where the estate is large, where property is located abroad, where there are family disputes or doubts about the testator’s capacity, a public will before a notary public is recommended.
