The main forms of terminating an apartment lease

A lease can be brought to an end in two main ways, each with its own legal basis:

• Termination by agreement. This is the most common and the simplest way of ending a lease. The legal basis for termination by agreement is the principle of freedom of contract in the Obligations Act (Zakon o obveznim odnosima), which allows the parties to agree at any time that the contractual relationship shall end. The termination agreement confirms that both parties have consented to ending the contract and that they have defined the terms for handing over the apartment, settling debts and returning the deposit.
• Notice of termination. When one party wants to terminate the contract unilaterally, the provisions on notice apply. Both the Residential Lease Act (Zakon o najmu stanova) and the Obligations Act (Zakon o obveznim odnosima) define a notice period (most often 3 months), as well as the grounds on which a contract may be terminated without observing the notice period (for example non-payment of rent, improper use of the apartment). Notice must be given in writing.

Other important notes

A lease agreement that has been notarially solemnized before a notary public has the force of an enforcement instrument. In that case the contract can be brought to an end through direct enforcement, without starting litigation, which considerably simplifies and speeds up the process of evicting the tenant or collecting a claim.
