Mutual termination of an employment contract – example is a ready-made template for situations in which the employee and the employer agree to end the employment relationship. A mutual termination agreement is a voluntary act of both parties which settles all the conditions of termination, from the date to the financial obligations, severance pay and the handover of work.
Unlike a unilateral termination, a mutual termination agreement requires neither a statement of reasons nor observance of the statutory notice period – everything is settled by agreement. What does the document include
- Employer and employee details: full details of both contracting parties – company name, OIB (personal identification number), registered office, representative, and the employee’s name, OIB and address.
- Article 1 – Termination date: the exact date on which the employment contract ends by agreement.
- Article 2 – Handover of work: the obligation to hand over work, documentation, work equipment and other property of the employer in an orderly manner.
- Article 3 – Financial obligations: payment of wages up to the termination date, compensation for unused annual leave, severance pay (if agreed) and other payments.

Frequently asked questions about mutual termination of an employment contract
Am I entitled to unemployment benefit after a mutual termination?
As a rule no. The HZZ (Croatian Employment Service) grants unemployment benefit only to people who are unemployed through no fault of their own. A mutual termination is regarded as a voluntary end to the employment relationship, so in most cases you are not entitled to benefit. There are exceptions if you can prove that you signed the agreement under duress or because the employer was in breach of the contract. If unemployment benefit matters to you, consider a regular termination instead of a mutual one.
Is there a notice period with a mutual termination?
No, with a mutual termination a notice period is not a statutory obligation. The employee and the employer agree the termination date themselves – it can be immediate, in a week or in several months. That is one of the advantages of a mutual termination agreement: flexibility in setting the termination date, without being bound by the statutory periods.
Can my employer force me into a mutual termination of the employment contract?
No, a mutual termination is strictly a voluntary act. If you feel pressured to sign, you have the right to refuse. Never sign a mutual termination agreement under pressure – that can be a ground for having the agreement annulled by a court. If your employer threatens you with dismissal unless you sign the agreement, document it and seek advice from a trade union or a lawyer.
Am I entitled to severance pay with a mutual termination?
The law does not require severance pay with a mutual termination – it is a matter of agreement between the employee and the employer. A mutual termination is precisely the opportunity to negotiate the conditions, including severance pay, compensation for unused annual leave and other benefits. It is advisable to set out all financial obligations clearly in the agreement.
What is the difference between a mutual termination agreement and a mutual dismissal?
In practice both terms are used for the same thing – an agreed end to the employment relationship between the employee and the employer. Legally, the more correct term is a mutual termination agreement, because it is a mutual arrangement and not a unilateral dismissal. Whatever it is called, the essential point is that the agreement is in writing and clearly defines all the conditions of termination.
How do you write a request for a mutual termination of an employment contract?
A request for a mutual termination is a proposal you send to the employer (or the other way round). It should contain your details, a statement that you are proposing a mutual termination, the desired termination date and any conditions (severance pay, annual leave). The employer may accept, refuse or propose different conditions. The agreement becomes legally valid only once both parties agree and sign it.
What are my benefit rights after a mutual termination if I worked for more than 2 years?
Length of service does not affect entitlement to unemployment benefit after a mutual termination – the HZZ as a rule does not grant benefit, because a mutual termination is regarded as a voluntary end to employment. However, length of service does affect the amount and duration of the benefit if you do become entitled to it (for example, where the agreement is annulled because of duress). Length of service can also be an argument for negotiating higher severance pay in the agreement itself.
