Frequently asked questions about the contract for work
What is the difference between a contract for work and an employment contract, and when do you use each?
A contract for work (ugovor o djelu) is for a one-off, defined job (building a website, writing a text). The contractor organises the work independently and has no working hours and no boss. An employment contract is for a continuing employment relationship with full rights. If a contract for work has the characteristics of an employment relationship, the inspectorate may reclassify it.
How much tax is payable on a contract for work and how much do you actually receive from the gross amount?
About 35-40% of the gross amount is deducted: pension contribution (10%), health contribution (7.5%), 20% tax on the base reduced by 30% of recognised costs, plus surtax. For a gross amount of 1000 €, the net is around 620-680 € depending on the surtax. Always agree whether the amount stated is gross or net.
Are you entitled to annual leave and sick leave if you work under a contract for work?
No. A contract for work is NOT an employment relationship – you have no right to annual leave, sick leave, severance pay, holiday allowance or other rights arising from employment. That is why the fee is usually higher than the salary for the same job. If you work for the same client for a long time, that may amount to a disguised employment relationship.
Can the tax authority or the inspectorate challenge a contract for work and turn it into an employment relationship?
Yes, if the contract has the features of an employment relationship: you work every day, you have fixed working hours, you use the client’s equipment, the client instructs you how to work, and you have only that one client. The inspectorate may then order an employment contract with full rights to be concluded retrospectively.
