Does a power of attorney for the sale of real estate have to be certified by a notary public?
YES, certification of the signature is MANDATORY. Without certification the land registry office will not register the new owner. The power of attorney must be a special one (for that one specific property) with precise powers. A general power of attorney is not sufficient for a sale.
Can my attorney-in-fact sell the property at any price, or can I set limits?
You can (and should) set limits: a minimum price, the period for which the power of attorney is valid, and the conditions of sale. Write, for example, that you authorise the sale at a price no lower than 100,000 €, or that the power of attorney is valid until a specified date. Without limits the attorney-in-fact has a free hand.
What must a power of attorney for the sale of real estate contain to be valid?
The mandatory elements are: your details (OIB personal identification number, address), the details of the attorney-in-fact, an EXACT description of the property (cadastral municipality, parcel number, land register folio, address), precise powers (sale, signing of the agreement, receipt of the purchase price), the place and date, and a certified signature.
Can I revoke a power of attorney for the sale of real estate if I change my mind?
Yes, you can revoke a power of attorney at any time – notify the attorney-in-fact and the notary public in writing. HOWEVER, if the attorney-in-fact has already started the sale (signed a preliminary agreement), the revocation may give rise to liability for damages towards the buyer. Revoke it as soon as you can.
