Does a power of attorney for the purchase of real estate have to be certified by a notary public?
YES, certification of the signature is MANDATORY if the attorney-in-fact is to sign the purchase agreement and carry out the registration of title. Without certification the land registry office will not register the change of ownership. The power of attorney must be a special one with precise powers – a general power of attorney is not sufficient for buying a property. Certification of a signature by a notary public costs around 6.00 €. We recommend that the power of attorney contains all the necessary details of the property (cadastral municipality, parcel number, land register folio) so that it is valid for registration of title.
Can I limit the maximum price the attorney-in-fact may pay for the property?
Yes, you can (and should) set limits in the power of attorney: the maximum purchase price, the period for which the power of attorney is valid, and specific conditions of purchase. Write, for example, that you authorise the purchase at a price no higher than 150,000 €, or define a price range. Without clearly stated limits the attorney-in-fact has a free hand and may buy the property at any price they consider acceptable. Limits protect your interests and prevent possible misunderstandings.
What if I am not sure which property I want to buy?
You can issue a power of attorney for the purchase of real estate with a more general description of the property you are looking for (for example, a flat in Zagreb of up to 80 m² in the price range up to 200,000 €). For the registration of ownership in the land register itself, however, a power of attorney with precise details of the specific property will be required (cadastral municipality, parcel number, land register folio). In that case you can issue a new, specific power of attorney later, once you have found the property you want.
Can I revoke a power of attorney for the purchase of real estate if I change my mind?
Yes, you can revoke a power of attorney at any time – notify the attorney-in-fact and the notary public who certified it in writing. However, if the attorney-in-fact has already signed the purchase agreement before receiving notice of the revocation, that agreement remains in force and the revocation does not annul it. That is why it is important to revoke the power of attorney as soon as possible if you change your mind. We recommend sending the revocation by recorded delivery with an acknowledgement of receipt as proof of delivery.
