What is the difference between a lifetime support agreement and a support until death agreement, and which is safer for the recipient?
The key difference is the moment at which ownership passes. With lifetime support, ownership passes to the provider only after the death of the recipient, whereas with support until death ownership passes immediately upon conclusion of the contract. For the support recipient the lifetime support agreement is safer, because the recipient remains the owner of the property until death. If the provider stops meeting the obligations, the recipient can simply terminate the contract without having to recover the property. With support until death the recipient loses ownership immediately and, if problems arise, has to seek the return of the property through the courts, which is more complex. As protection under a support until death agreement, it is advisable to register a right of habitation in favour of the recipient. Both contracts must be notarially solemnized before a notary public, otherwise they are null and void.
Can the heirs challenge a lifetime support agreement and claim their share of the estate?
Yes, heirs may challenge a lifetime support agreement before the court, and the most common grounds are failure by the provider to perform the obligations or infringement of the forced share. Forced heirs (children, spouse) are entitled to a forced share amounting to half of the statutory share of the estate, and it cannot be taken away from them even by contract. If the value of the property transferred by the contract significantly exceeds the value of the support, the heirs may claim a top-up of the forced share. Common grounds for challenge include claims that the recipient was not capable of concluding the contract or that he or she was under pressure. A lack of documentation about the support actually provided makes it harder to defend the contract. To protect the contract it is advisable to keep detailed records of the care provided, to keep receipts and to have witnesses. Consulting a lawyer before signing can prevent future disputes.
What happens if the support provider stops meeting the obligations – can I terminate the contract?
Yes, the support recipient has the right to terminate the contract if the provider stops meeting the care obligations defined in it. Termination is initiated by an action before the competent court, and the recipient must prove that the provider failed to meet the agreed obligations. Typical grounds for termination include failure to provide food, medicines or medical care, or abandoning the recipient altogether. The court will assess the seriousness of the breach and the circumstances of the case before deciding on termination. Under a lifetime support agreement the recipient remains the owner of the property, so termination restores the original position. Under a support until death agreement, termination requires the property to be returned by the provider, which is more complex. It is advisable to define the provider’s obligations clearly in the contract and to keep records of their performance. Reacting quickly to problems increases the chances of a successful termination.
Must a lifetime support agreement be certified by a notary public, or is the signature of the parties enough?
A lifetime support agreement must be notarially solemnized before a notary public – mere certification of signatures or an ordinary written contract is not enough, and such a contract would be null and void. Solemnization is a stricter procedure than certification of a signature and includes reading the contract aloud, checking that the parties understand it and warning them of the legal consequences. The notary public checks that both parties have legal capacity and that they are entering into the contract of their own free will. This mandatory form exists because of the significance of the transaction – it involves the transfer of property and the creation of a long-term care obligation. The parties must attend the notary public in person – a power of attorney is not permitted for this contract. The cost of solemnization depends on the value of the property and ranges from a few dozen to a few hundred euros. Without solemnization the contract has no legal effect.
